Local Guidelines
Fence Rules & Permits in Downey, CA

A few things to consider before you install a fence in Downey. These are general guidelines — always confirm current requirements with the City before you start.

📏
Front Yard Height
Downey holds residential walls, fences and hedges to 42 inches in the front and street-side setback, measured from the top of the nearest street curb, and 30 inches inside the corner cutback. Chain link is prohibited in front and street-side yards, and barbed wire, razor wire and electrified fencing are banned in residential zones. Any wall face visible from the street must get an anti-graffiti coating.
🧱
Side & Rear Yard Height
Interior side and rear property lines may be fenced up to 7 feet outside the required front or street setback, measured from the higher finished grade of the two lots. On a corner lot a 7-foot wall is allowed along the street side if it sits at least 3 feet from the side-street property line and no closer than 35 feet to the front property line. Block walls under 7 feet can use the City's standard block wall detail.
📋
When You Need a Permit
Downey's Building Code only exempts walls and fences up to 42 inches, so any 6- or 7-foot fence or block wall needs a building permit from Building and Safety, with a plot plan showing all walls, driveways and heights. A wall on or next to a shared property line needs a signed Common Wall Agreement or a certified property line survey. Retaining walls over 4 feet, or any retaining wall supporting a surcharge, require engineered plans.
🚦
Corner Lots & Sight Lines
Corner lots must keep a 25-foot visibility triangle clear at the intersection, measured along the property lines from the corner, and nothing inside it, including fences, walls and unpruned landscaping, may exceed 30 inches. Walls or fences taller than 42 inches also need 5-foot triangular setbacks where they meet driveways and alleys within the required setback area.
Good to Know
If your home is part of an HOA, check your community's CC&Rs before installing — many HOAs add their own material and height rules on top of the City's. Building a pool or spa? California's Pool Safety Act (Health & Safety Code §115922–115923) requires at least two independent, approved drowning-prevention features, such as a 60-inch enclosure. Fence codes can change, so we always recommend confirming current requirements with the Downey Community Development Department before you start. Have questions about your property? Contact Legacy Fence and we'll help you sort it out.

The Legacy Fence team were responsive, patient, professional, and accommodating. I had them install a boundary fence with my neighbor, and there were specific demands from both homeowners — they were flexible in making sure every concern was met. Definitely recommend Jose and his team!
